Review of the Cemeteries Act 1986 - Position Paper January 2007
As part of the process of reviewing the Cemeteries Act 1986, a Position Paper has been prepared for your consideration and comments. The Paper marks the second stage in the review of the Cemeteries Act 1986.

The Paper contains approximately thirty-six proposals. The more significant proposals contained in the Paper relate to the redevelopment of land used in cemeteries for burials. A number of proposals relate to cremations including the transfer of specific provisions relating to the establishment and management of crematoria from the Cremations Act 1929 into the Cemeteries Act 1986. Many of the proposals are aimed at enhancing existing provisions within the Act. In some cases the proposals add requirements to existing provisions to make them clearer or to provide additional powers. Proposals have also been included to increase the level of penalties, to provide for appeals and to allow cemetery boards to delegate their powers of operation.

The release of the Paper marks the beginning of a two-month public consultation period, ending on 31 March 2007 that provides you with an opportunity to comment on the proposals. Consideration of submissions will lead to a revised set of proposals being prepared for final approval and the drafting of amendments to the Act.
