Review of the Cemeteries Act 1986
Review of the Cemeteries Act 1986 - Position Paper January 2007
A review of the Cemeteries Act 1986 began in 2007. The review involved the release of a Discussion Paper, a Position Paper and incorporated extensive community consultation.

The Position Paper included thirty-six proposals, twenty-one of which are now being prepared for final approval and the drafting of amendments to the Act.

Most proposals aim to enhance the Act by adding requirements to existing provisions to make them clearer and, in some cases, provide additional powers.

Significant proposals relate to:
  • The redevelopment of land used in cemeteries for burials.
  • The transferral of provisions from the Cremations Act 1929 into the Cemeteries Act 1986.
  • Allowing cemetery boards to delegate their powers of operation.
  • Increasing the level of penalties, and
  • Providing for appeals.
