Local Government Amendment Bill 2008
In June, the Local Government Amendment Bill 2008 was introduced into the Legislative Assembly. The Bill contains approximately 40 proposed amendments to the Local Government Act 1995.
Key matters in the Bill include:
- giving local governments powers to enter land to remove graffiti;
- widening the circumstances that local governments can take gravel and other building materials from land for building purposes (roads);
- clarification of the powers of the Minister to place mining developments on the gross rental value system of rating;
- allowing councils flexibility to have either a separate general electors’ meeting or in conjunction with an appropriate ordinary council meeting;
- clarification regarding the power to approve the appointment of deputies for regional councils and local government committees;
- improving various accountability provisions relating to declaring financial interests, elections donations (to be specified in regulations) and restricting the types of gifts that council members may receive (to be specified in regulations);
- stronger powers for the Department of Local Government and Regional Development to obtain information when carrying out investigations; and
- minor improvements to provisions relating to enrolment for local government elections.
